Terms of service

These terms govern the use of the foxxy.pro site and of the Foxxy service, a Kiware.co product. By using the site or subscribing to the service, you accept what is described here.

1. What the service is

Foxxy is management software delivered as a subscription service. It lets you manage bookings, rooms, shifts, commissions and payments. Foxxy is an administrative tool: it does not take part in the services the establishment provides, nor in its relationship with its clients or its team.

2. Who can subscribe

The service is intended for individuals or legal entities of legal age who operate a legally constituted business. The customer declares that its activity complies with the regulations applicable in its jurisdiction, including licenses, land-use permits and labor and tax obligations.

3. Customer obligations

• Verify that every person registered on the platform is of legal age and takes part freely and voluntarily.
• Safeguard the access credentials of its team and report any unauthorized use.
• Process the personal data it uploads to the platform in accordance with applicable regulations, acting as the controller of that processing.
• Not use the service for any unlawful activity.

Failure to meet these obligations entitles us to suspend the service immediately. Any indication of the involvement of minors or of coercion entails termination of the contract and a report to the competent authorities.

4. Subscription and payments

The plans, prices and limits in force are those published in the pricing section. The subscription is billed for the contracted period. Price changes are announced with reasonable notice and apply from the following billing period.

5. Availability

We work to keep the service continuously available, but there may be interruptions due to maintenance or causes beyond our control. We will announce scheduled maintenance in advance whenever possible.

6. Customer data

The information the customer uploads to the platform belongs to the customer. Foxxy processes it solely in order to provide the service. When the relationship ends, the customer may request an export of its data within the period indicated to it.

7. Intellectual property

The software, the brand and the contents of the site are the property of Kiware.co. The subscription grants a right of use, not a transfer of those rights.

8. Termination

Either party may end the relationship at the end of the contracted period. We may also suspend it immediately in the event of a serious breach of these terms.

9. Governing law

These terms are governed by Colombian law. Any dispute will be submitted to the competent courts of Colombia.
